License issues

We have a reasonable installed base of DiskXtender with versions < 6. In these cases the device was licensed, giving the possibility to use unlimited media with the device.
The last version we bought was 6.10 in combination with LTO2, our distribitor made the following offer (on the moment EMC changed the licensing structure):

The license manager shows the following:
DiskXtender File System Manager
File System Manager Licenses: 1 (1 in use)
Storage Capacity: 400 GB (400 GB in use)


After using two 200GB tapes the product enters a grace period due to (400 GB in use).
We thought (and I'm sure the distributor also !) at that moment, that 400GB represented the capacity of the device, which would provide us with the same functionality as versions < 6, not the total usable capacity.
When escalating this to the distributor, an offer for an additional 500GB was sent.

EMC changed the licensing structure 180 degrees, going from device to useable capacity giving the product an enormous, unacceptable Total Cost of Ownership.

Anyone has the same experience, or is there something wrong in the initial offer ?

I issued an official complaint to our distributor after serveral phone calls and emails without results.

To my knowledge the term capacity as it relates to the DX license has always been defined by the amount of data migrated to a Media Service ever since 6.x was introduced. We have customers with 20 platter jukeboxes previously licensed as Level C in the 5.x world. Before they upgrade we get a new key from EMC that represents the amount of data they've migrated + some additional space to support growth. I can't tell you whether there is some charge associated with this process. I can tell you ongoing maintenance is assessed at list price for the 6.x software which in some cases can be more expensive than the 5.x series.
